Bongo Operations Pty Ltd Bongo Terms of Service


By signing up for Bongo Operations Pty Ltd ‘ Bongo service (“Service”) and indicating that you agree to these terms and conditions (“TOS”). The fee for the chosen service will be billed directly to your cellular phone bill or deducted from your prepaid balance. Standard text messaging tolls and other fees charged by your wireless carrier may apply.

 

Termination

This agreement continues until terminated. Bongo Operations Pty Ltd reserves the right to modify or terminate the Service or these TOS at any time for any reason. You may cancel your subscription at any time by sending a text message with “CANCEL”, “STOP,” “END” or “QUIT” to short code 505050.

 

Service Requirements

Your phone must have text messaging capability. You must be the owner of your cell phone and either be at least eighteen (18) years old or have the permission of your parent or guardian to purchase the Service.

 

Warranty

THE SERVICE IS PROVIDED “AS-IS” AND “AS AVAILABLE” WITH NO WARRANTY OF ANY KIND. Bongo Operations Pty Ltd AND ITS THIRD PARTY SERVICE PROVIDERS EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED REGARDING THE SERVICE INCLUDING ANY IMPLIED WARRANTY OF QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. Bongo Operations Pty Ltd MAKES NO WARRANTY THAT THE SERVICE WILL BE ERROR FREE. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

 

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER Bongo Operations Pty Ltd NOR ITS THIRD PARTY SERVICE PROVIDERS WILL BE LIABLE FOR ANY INCIDENTAL, SPECIAL CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM YOUR ACCESS TO AND/OR USE OF THE SERVICE. YOU AGREE THAT THE AGGREGATE LIABILITY OF Bongo Operations Pty Ltd FOR ANY AND ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO $100.

 

Indemnity

You agree to defend, indemnify and hold Bongo Operations Pty Ltd, its officers, directors, employees, third party service providers and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including, but not limited to, reasonable legal and accounting fees, arising out of or in any way connected with your access to and/or use of the Service (including but not limited to alleged infringement of any intellectual property rights) or your violation of these TOS.

 

General

In the event that any provision of these TOS is held invalid or unenforceable, the remaining provisions of these TOS will remain in full force and effect. The failure of Bongo Operations Pty Ltd to enforce any right or provision of these TOS will not be deemed a waiver of such right or provisions.
